Appeal No. 2004-1523 Application 09/506,920 Appellant’s invention is directed to a process and apparatus for folding a moving web which can more consistently and more accurately fold a selected side portion of the moving web. Independent claims 1, 16, 34 and 35 are representative of the subject matter on appeal and a copy of those claims can be found in the Appendix to appellant’s brief. The prior art references relied upon by the examiner in rejecting the appealed claims are: Osborn et al. (Osborn) 4,819,928 Apr. 11, 1989 Smithe et al. (Smithe) 6,210,309 Apr. 3, 2001 Claims 1 through 7, 10, 11, 16, 17, 21, 23, 24, 27 and 34 through 40 stand rejected under 35 U.S.C. § 102(e) as being anticipated by Smithe.
