                                 DECISION ON APPEAL                                   
               This is a decision on an appeal which involves claims 1-20.            
               The subject matter on appeal relates to an electrochemical             
          battery having an anode of carbon, a cathode of a modified                  
          lithium metal oxide and a Schottky diode connected between the              
          anode and the cathode.  Further details of this appealed subject            
          matter are set forth in representative independent claims 1, 12
