2 ORDERED that judgment on priority as to Count 3, the sole count of the
3 interference, is awarded against junior party RANDY M. BERKA, DANIEL CULLEN,
4 GREGORY L. GRAY, KIRK J. HAYENGA, and VIRGIL B. LAWLIS;
5 FURTHER ORDERED that junior party RANDY M. BERKA, DANIEL
6 CULLEN, GREGORY L. GRAY, KIRK J. HAYENGA, and VIRGIL B. LAWLIS is not
7 entitled to a patent containing claims 34 and 53 of patent 5,364,770, which claims
8 correspond to Count 3;
9 FURTHER ORDRED that junior party RANDY M. BERKA, DANIEL
10 CULLEN, GREGORY L. GRAY, KIRK J. HAYENGA, and VIRGIL B. LAWLIS is not
11 entitled to a patent containing claims 37, 65, and 81 of patent 5,578,463, which claims
12 correspond to Count 3;
13 FURTHER ORDERED that a copy of this judgment shall be entered into
14 the administrative records of Berka patents 5,364,770 and 5,578,463 and Boel
15 application 08/435,557.
