requesting remand to the Examiner for issuance of a Notice of
Intent to Issue a Reexamination Certificate confirming the
patentability of dependent claims 2, 5 and 7. Applicant also
filed a NOTICE OF CONCURRENT PROCEEDINGS stating that he had
filed a reissue application on April 4, 2006.
Accordingly, it is ORDERED that Appeal No. 2006-0736,
scheduled for hearing on April 6, 2006, is dismissed.
The application is being returned to the examiner for
further action as may be appropriate.
