Appeal 2006-1994 Application 10/253,705 teaching that NIR (wavelength of 0.7 to 1.2 µm) is used to irradiate a thermoreactive coating to determine that 100% of the radiation has wavelengths falling within the claimed range (i.e., 0.7 to 1.5 µm) (Answer 5-6). We do not find impermissible hindsight involved in the Examiner’s patentability determinations. Accordingly we affirm the Examiner’s § 103(a) rejection of claims 1 and 2. We also affirm the § 103(a) rejections of non-argued claims 3-18. CONCLUSION We have affirmed with respect to the § 103(a) rejection of claims 1- 12, 14, and 18 over Sedlmeyr. We have affirmed with respect to the § 103(a) rejection of claims 13, 15, and 16 over Sedlmeyr in view of Tate. We have affirmed with respect to the § 103(a) rejection of claim 17 over Sedlmeyr in view of Kruwinus. The decision of the Examiner is affirmed. No time period for taking any subsequent action in connection with the appeal may be extended under 37 C.F.R. § 1.136(a)(1)(iv).
