Combustion propelled engines or machinery
Sec. 8. (a) It is unlawful for any owner or operator of a coal mine
who is engaged in removing any material or product from under the
surface of the earth to use or operate any combustion propelled
engines or machinery in any such operation underneath the ground
where employees are engaged at work, unless such equipment is:
(1) rated "permissible" for underground use by the United
States Bureau of Mines or the Mine Safety and Health
Administration; and
(2) maintained in permissible condition by the owner or
operator.
(b) In mines using permissible combustion propelled engines or
machinery the director may enforce any requirements for monitoring
or testing of carbon monoxide (CO) as may be specified in the
ventilation system, methane gas (CH ) and dust control plan
approved under the Federal Mine Safety and Health Act of 1977.
