General Laws of Massachusetts - Chapter 119 Protection and Care of Children, and Proceedings Against Them - Section 39I Appeal; rights and procedures

  Section 39I. A child, parent, legal guardian or custodian may appeal from any order or determination made under sections 39E to 39H, inclusive. Pending the appeal, the court shall retain jurisdiction and may enter any order under this chapter to meet the needs of the child. Notwithstanding any general or special law to the contrary, the appeal shall be to the appeals court under section 118 of chapter 231 and shall proceed under the Massachusetts Rules of Appellate Procedure that govern child welfare cases.

  Section 39I. A child, parent, legal guardian or custodian may appeal from any order or determination, whether final or not final, made under sections 39E to 39H, inclusive. Pending the appeal, the juvenile court shall retain jurisdiction and may enter any order under this chapter to meet the needs of the child. Notwithstanding any general or special law to the contrary, the appeal shall be to a single justice of the appeals court under section 118 of chapter 231 and shall proceed in accordance with the procedures governing petitions to a single justice.
