Variance or exemption from regulation of Board: Application; notice and hearing; participation of Public Utilities Commission of Nevada.
1. A supplier of water may apply to the State Board of Health for a variance or exemption from the Board’s regulations. The Board may grant variances or exemptions after notice and public hearing.
2. A supplier of water shall notify all users of the water system as soon as the Board has scheduled a time and place for the public hearing on the application for a variance or exemption.
3. The Public Utilities Commission of Nevada may participate in the hearing.
