“Employee”: Persons participating in federally approved training programs.
1. Any person who participates in a training program approved pursuant to 29 U.S.C. §§ 1501 to 1781, inclusive, is entitled to the benefits of chapters 616A to 616D, inclusive, of NRS and, except as provided in subsection 2, shall be deemed an employee of the person receiving the grant to conduct the program, at a wage:
(a) Of $150 per month if he is receiving formal instruction in a classroom;
(b) Equal to his actual remuneration if he is being trained under actual working conditions and he is paid a wage by the recipient of the grant; or
(c) Of $150 per month or his actual remuneration, whichever is greater, if he is being so trained and instructed and receiving a wage from the recipient of the grant.
2. Any person who participates in a training program approved pursuant to 29 U.S.C. §§ 1501 to 1781, inclusive, where he is trained on the job and is paid a wage directly by the employer shall be deemed an employee of that employer and is entitled to the benefits of chapters 616A to 616D, inclusive, of NRS.
