“Higher-tiered subcontractor” defined. “Higher-tiered subcontractor” means a subcontractor under a contract who has entered into an oral or written subcontract with another subcontractor pursuant to which the other subcontractor has agreed to perform any of the duties of the subcontractor under the oral or written subcontract.
