Appointment of hearing officer or panel to conduct hearing or investigation; appeal to Board; action by Board.
1. The Board may appoint a hearing officer or a panel of its members to conduct any hearing or investigation which may be conducted by the Board pursuant to this chapter.
2. A decision of the hearing officer or panel relating to the imposition of a fine is a final decision in a contested case. A decision of the hearing officer or panel to place a psychologist on probation or revoke or suspend a license may be appealed to the Board.
3. On appeal to the Board, the Board shall consider the record of the hearing, and either affirm the decision or remand the case to the panel of its members or the hearing officer for further proceedings. The Board shall issue written findings of fact and conclusions of law.
