Commencement of action in district court to establish claim. Any person aggrieved by a decision of the Administrator, or as to whose claim the Administrator has failed to render a decision within 90 days after the filing of the claim, may commence an action in the district court to establish his claim. The proceeding must be brought within 90 days after the decision of the Administrator or within 180 days after the filing of the claim if the Administrator has failed to render a decision. The action must be tried without a jury in cases where the Administrator has failed to render a decision.
