2334. Houses of prostitution; criminal proceedings; duty of district attorney. 1. In case the existence of a nuisance as defined in this article, is established, in a criminal action in a court other than the supreme court it shall be the duty of the district attorney to proceed promptly under the provisions of this article to enforce the provisions and penalties thereof.

2. The conviction of the defendant in such criminal action, unless reversed or set aside, shall be conclusive as against such defendant as to the existence of the nuisance.
