New York Public Housing Law Section 463 - Rochester Housing Authority.

463. Rochester Housing Authority. 1. A municipal housing authority to be known as the Rochester Housing Authority, is hereby created and established for the city of Rochester in the county of Monroe for the accomplishment of any or all of the purposes specified in article eighteen of the constitution of the state of New York. It shall constitute a body corporate and politic, be perpetual in duration and consist of five members. It shall have the powers and duties now or hereafter conferred by this chapter upon municipal housing authorities. It shall be organized in the manner prescribed by and subject to the provisions of this chapter, and the authority, its members, officers and employees and its operations and activities shall in all respects be governed by the provisions of this chapter.

2. Notwithstanding any general, special or local law or existing contracts between the city of Rochester and the state of New York, the city of Rochester is hereby authorized and empowered to sell, grant and convey at private sale to the Rochester Housing Authority and such housing authority is hereby authorized to acquire all of the real and personal property, structures, fixtures, facilities and appurtenances of or used in connection with the public housing project in the city of Rochester, known as Hanover Houses and designated as no. NYS-53 together with all other assets, including but not limited to, cash in banks, securities and accounts receivable. Said transfer and conveyance shall be subject to all existing contracts, leases, special agreements, compensation awards and pending tort claims affecting the project.

3. Upon transfer, conveyance and delivery as provided in subdivision two of this title, all the rights, duties, liabilities, and responsibilities of the city of Rochester relative to NYS-53, including the loan and subsidy contract with the state of New York, dated September seventh, nineteen hundred forty-nine, as thereafter amended, and as prescribed by this chapter shall succeed to, be assumed by and shall devolve upon the Rochester Housing Authority, but nothing herein shall be deemed to release the city of Rochester from any existing liability under such loan and subsidy contract.

4. The commissioner of housing, the city of Rochester and the Rochester Housing and Rehabilitation Authority are hereby authorized and empowered to make and execute any and all contracts, deeds, conveyances, transfers, assignments and other instruments and to perform any and all acts necessary or convenient to carry out the purpose of the provisions of this title.
