Oregon Statutes - Chapter 197 - Comprehensive Land Use Planning Coordination - Section 197.831 - Clear and objective approval standards; burden of proof.

In a proceeding before the Land Use Board of Appeals or on judicial review from an order of the board that involves an ordinance required to contain clear and objective approval standards for a permit under ORS 197.307 and 227.175, the local government imposing the provisions of the ordinance shall demonstrate that the approval standards are capable of being imposed only in a clear and objective manner.
