Oregon Statutes - Chapter 366 - State Highways and State Highway Fund - Section 366.360 - Taking fee simple title.

In all cases where title to real property is acquired by the Department of Transportation either by donation, agreement or exercise of the power of eminent domain, a title in fee simple may be taken.
