Petitioners attempted to solicit business by circulating flyers to incoming tourists at area airports. They also relied upon "word of mouth" referrals from previous customers. Other than these two methods, petitioners used no advertising. They did not offer the charter boat service through brokers or rental agents. Petitioners would generally charter the boat only on weekends or other times that did not conflict with Hans Hammann's employment with the union. Petitioners were always present on the Malaguena during the charters. They would only allow a member of a charter party to actually sail the boat if the person passed a sailing proficiency test administered by Hans Hammann, who was an experienced sailor. When a member of a charter party was sailing the sailboat, petitioners described themselves as "the crew". From time to time Cheryl Hammann would prepare meals in advance and serve them to the charter party while sailing.
