LONCHAR v. THOMAS

Rehnquist, C. J., concurring in judgment

an erroneous view of the law," Schlup v. Delo, 513 U. S. 298, 333 (1995) (O'Connor, J., concurring) (citing Cooter & Gell v. Hartmarx Corp., 496 U. S. 384, 405 (1990)), the District Court necessarily abused its discretion in determining there was abuse of the writ.
