If the Governor finds the referendum in order and that at least a simple majority of those voting are in favor of the assessment for the purpose of conducting programs in market development, education, publicity, research and the promotion of the sale and use of small grains, he shall so proclaim and establish within the Virginia Department of Agriculture and Consumer Services a Virginia Small Grains Board as defined in § 3.1-684.41.
