§ 3.1-722.28. (Repealed effective October 1, 2008) Violation a misdemeanor; illegal acts relating to issuance of ...

Any person who shall violate any of the provisions of this article or the rules and regulations established by the Board of Agriculture and Consumer Services shall be guilty of a misdemeanor. Any grain dealer or employee or manager for a grain dealer who (i) issues any storage, grain exchange or grain banking receipts for any grains that are not actually in a storage facility at the time of issuing such receipt, (ii) issues any grain receipt, including a scale ticket, that is in any respect fraudulent in its character, either as to its date or to the quantity, quality or inspected grade of such grain, or (iii) removes any grain from a storage facility, except to preserve the same from fire or other damage or to move from storage to another facility operated by the grain dealer and licensed by the grain dealer under this article, without the permission of the producer or his agent shall, when convicted thereof, be guilty of a Class 6 felony.
