§ 3.1-884.31. (Repealed effective October 1, 2008) General criminal penalties; warning letter

(1) Any person that violates any provisions of this article for which no other criminal penalty is provided by this article shall upon conviction be subject to confinement in jail for not more than one year, or a fine of not more than $500, or both; but if such violation involves intent to defraud, or any distribution or attempted distribution of an article that is adulterated (except as defined in subdivision (15)(k) of § 3.1-884.18) knowing the article to be adulterated, such person shall be subject to imprisonment in a state correctional facility for not less than one year, nor more than three years or a fine of not more than $10,000 or both.

(2) Nothing in this article shall be construed as requiring the Commissioner to report for prosecution or for the institution of condemnation or injunction proceedings, minor violations of this article whenever he believes that the public interest will be adequately served by a suitable written notice of warning.
