Any officer, director, agent or employee of any bank, trust company or trust subsidiary who embezzles, abstracts, or willfully misapplies any of the moneys, funds or credits of, or in the possession or control of such corporation, shall be guilty of larceny and punished as provided by law. Any officer, director, agent or employee of any bank, trust company or trust subsidiary who issues or puts forth any certificate of deposit, draws any order or bill of exchange, makes any acceptance, assigns any note, bond, draft, bill of exchange, mortgage, judgment, decree or other instrument in writing, or who makes any false entry in any book, report or statement of such bank, trust company or trust subsidiary with intent in any case to injure or defraud such corporation, or any other company, body politic or corporate, or any individual person, or to deceive any officer of such corporation, or the State Corporation Commission, or any agent or examiner authorized to examine the affairs of such corporation, and any person, who, with like intent, aids or abets any such officer, director, agent or employee of such bank, trust company or trust subsidiary in any such violation, shall be guilty of a felony and upon conviction thereof shall be confined in a state correctional facility not less than one year or more than ten years, or be confined in jail not exceeding twelve months and fined not exceeding $5,000.
Any such officer who knowingly makes a false statement of the condition of any such bank or institution, shall be deemed guilty of a felony and upon conviction shall be fined not less than $100 nor more than $5,000, and be imprisoned in a state correctional facility not less than one nor more than ten years.
