Section 45-44-84.21 - Schedule of fees.

(a) In Macon County the judge of probate, in lieu of the fees prescribed by the general law for the following services, shall charge and collect for such services the following fees:

(1) Probate of will of not more than five pages, whether contested or not, with three copies of letters and including partial or final settlement when not more than 10 pages. An additional charge of one dollar fifty cents ($1.50) per page for will over five pages in length and for partial or final settlements in excess of 10 pages in length shall be made $50

(2) Grant of letters of administration with three certified copies of letters of administration $30

(3) Final settlement of administration of an estate when not more than 10 pages when over 10 pages an additional charge of $1.50 per page $30

(4) Partial or final settlement of guardianship $30

(5) Each additional certified copy of letters testamentary, letters of administration, or letters of guardianship $ 2

(6) Proceedings in filing and granting petition of adoption including one certified copy of decree for petitioner, one certified copy for the Department of Human Resources, and one copy to the office of Vital Statistics of the State Department of Public Health. Fee shall apply to each child adopted $30

(7) Proceedings in legitimations, fee to apply to each child $30

(8) Proceedings in change of name $15

(9) Each certified copy of a marriage certificate $ 2

(10) Proceedings appointing notary public and recording $10

(11) Recording the change of ownership of an automobile or other motor vehicle as provided in Section 40-10-260 $ 3

(12) Each document processed relative to a certificate of title of a motor vehicle for which a fee for the state is charged, the judge of probate shall add to such state fee and retain as his or her commission the sum of $ 1

(b) When an application for a replacement for a motor vehicle tag, plate, or validation stamp that has been lost, mutilated, or destroyed is filed with the judge of probate he or she shall collect four dollars ($4) and shall forward one dollar ($1) thereof to the State Department of Revenue for the replacement tag or validation stamp, and the judge of probate shall retain three dollars ($3) for his or her services.

(c) Except as provided in subsection (a) and subsection (b) the Judge of Probate of Macon County shall continue to charge and collect the fees for services which he or she renders that are prescribed by general or local law.
