(a)(1) Persons currently residing in nursing and convalescent homes and permanently disabled persons confined to home in Mobile County shall be entitled to register to vote by mail if they possess the qualifications of an elector and are not disqualified from voting under the Constitution and laws of Alabama, provided, that such persons shall be entitled to register by mail only if they were residents of Mobile County prior to entering the status which makes them eligible for such registration, and are certified to be so disabled or confined by a licensed medical doctor.
(2) An application for absentee registration shall be filed with the Board of Registrars of Mobile County. The board shall furnish the applicant a written application in the same form as that provided other applicants and any additional application deemed necessary to determine eligibility to register, which application shall be answered by the applicant without assistant and shall be verified before a notary public of the State of Alabama. Such application shall be filed with the records of the board. The board may take other testimony respecting the applicant and the truthfulness of any information furnished by him or her. Any additional testimony so taken shall be reduced to writing and shall be sworn to by the witness before a member or clerk of the board or notary public.
(b) Any individual who registers to vote, or causes an individual to register to vote, under this section who is not permanently disabled or currently residing in a nursing or convalescent home shall be guilty of a misdemeanor.
