Section 45-49-91.17 - Violations.

In case any building or structure is erected, constructed, reconstructed, altered, repaired, converted, or maintained, or any subdivision is established, or land used in violation of this part or of any ordinance or other regulation made under the authority conferred hereby, the board or other appropriate administrative officer designated by the board may institute any appropriate action or proceeding to prevent the unlawful erection, construction, reconstruction, alteration, repair, conversion, maintenance, or subdivision of the land or use of the land to restrain, correct, or abate the violation, or to prevent the occupancy of the building, structure, subdivision of land or to prevent any illegal act, conduct, business, or misuse in or upon any premises regulated under the authority conferred by this part. In addition to all other remedies, the court shall provide a civil penalty of not less than one hundred dollars ($100) nor more than five hundred dollars ($500) for a violation of the board's ordinance or regulation, and the penalty shall be assessed on a daily basis for each day in which the violator fails to comply with the ordinance or regulation as ordered by the court. All penalties shall be deposited to the board’s fund or account and may be expended only on the operational expenses of the board.
