encoding of the Ig heavy and light chains of CEA.66-E3 or any other immunoglobulin DNA
were known at any time before the Boss et al. filing date.
Decision
In view of the foregoing, judgment is entered against Shmuel Cabilly et al., Herbert
L. Heyneker, William E. Holmes, Arthur D. Riggs, and Ronald B. Wetzel, the junior party,
who are not entitled to a patent containing claims 101 through 120 corresponding to the
count.
On this record, judgment is entered in favor of Michael A. Boss et al., John K.
Kenten, John S. Emtage and Clive R. Wood, the senior party, who are entitled to their
