Appeal No. 1996-0532 Application 08/080,449 REQUEST FOR REHEARING UNDER 37 CFR § 1.197(b) On January 24, 2000, appellants filed “Response To Decision On Appeal Under 35 U.S.C. § 134", in effect requesting rehearing of our Decision on Appeal Under 35 U.S.C. § 134, mailed November 17, 1999 (Paper No. 51) under 37 CFR § 1.197(b). Other than commentary with regard to applicable fees, the paper reads (page 1 of 2 pages): In response to the Decision mailed November 17, 1999, the Applicants request that the application be reheard under §1.197(b) by the Board of Patent Appeals and Interferences upon the same record. (See option no. 2 at page 15 of the Decision). Pertinent to our ruling on appellants’ request for rehearing under 37 CFR § 1.197(b), the regulation requires: The request for rehearing must state with particularity the points believed to have been misapprehended or overlooked in rendering the decision and also state all other grounds upon which rehearing is sought.
