               Appeal No. 1999-0445
               Application No. 08/351,583

specification, was sufficient to convey to one of ordinary skill in the art that the appellant was
in possession of the invention now recited in claim 4, i.e., a noncontact tonometer comprising,
inter alia, a processing means as recited in the last paragraph of claim 1 which monitors a
gradient in the standard pressure curvature and a gradient in the pressure changing curvature at
the time detected by the time detection means.
For the foregoing reasons, we cannot sustain the examiner's rejection of the claims
under the first paragraph of 35 U.S.C. 112 on the basis that the specification as originally
filed fails to provide written descriptive support for the subject matter now claimed.
