In our MEMORANDUM OPINION and ORDER entered 4 January
2000 (Paper 236), Palackal was ordered to show cause why
judgment should not be entered against Palackal claims 1-2
(page 74) and Resconi was ordered to show cause why judgment
should not be entered against Resconi claims 14-18 (page 74).
Resconi has responded with a COMMUNICATION PURSUANT TO
PAPER NO. 236 MEMORANDUM OPINION AND ORDER (Paper 237)
indicating that it will not respond.
Palackal has responded with a RESPONSE BY PALACKAL ET AL.
TO MEMORANDUM OPINION AND ORDER (Paper 238) indicating that it
will not respond.
Since neither party has elected to file a response, a
judgment consistent with our MEMORANDUM OPINION and ORDER is
being entered as part of this paper.
B. Palackal's requests for clarification
Palackal makes two requests for modification of the
MEMORANDUM OPINION and ORDER.
1. Palackal requests that the MEMORANDUM OPINION
and ORDER be modified to indicate that Palackal Preliminary
Motion 1 is granted (Paper 238, page 2). On page 74 of the
MEMORANDUM OPINION and ORDER, we state that it is "FURTHER
ORDERED that Palackal Preliminary Motion 1 is granted."
