Appeal No. 1999-0097 Application No. 08/532,976 ferromagnetic powder dispersed in a binder. The binder is a polyurethane resin prepared by reacting a long chain diol, a short chain diol and an organic diisocyanate. The long chain diol is present in an amount of 1 to 5 mol% and is defined by the recited formula. Appellants submit at page 3 of the principal brief that "[c]laims 1, 2, 7, 8, 13 and 14 stand or fall together." Accordingly, all the appealed claims stand or fall together with claim 1. Appealed claims 1, 2, 7, 8, 13 and 14 stand rejected under 35 U.S.C. § 103 as being unpatentable over Kolycheck and Ohkubo. We have thoroughly reviewed each of appellants' arguments for patentability, as well as the specification data relied upon in support thereof. However, we are in full agreement with the examiner that the claimed subject matter would have been obvious to one of ordinary skill in the art within the meaning of § 103 in view of the applied prior art.
