Appeal No. 2001-0150 Application No. 09/250,617 The prior art The prior art references relied upon by the examiner in rejecting the appealed claims are: Deaver 803,274 Oct. 31, 1905 Bisk 4,765,495 Aug. 23, 1988 The rejections Claim 5 stands rejected under 35 U.S.C. § 112, second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which applicants regard as the invention. Claim 4 stands rejected under 35 U.S.C. § 102(b) as being anticipated by Deaver. Claims 3 and 5 stand rejected under 35 U.S.C. § 103 as being unpatentable over Deaver in view of Bisk.
