DECISION ON APPEAL
This is a decision on appeal under 35 U.S.C. § 134 from the examiner’s
final rejection of claims 1, 2, and 4-15, all of the claims remaining. Claim 1 is
representative and reads as follows:
1. An osmotic solid caplet for delivering a maximum dose of a drug to
a patient, the osmotic caplet comprising:
(1) a cylindrical body;
(2) a dose of 300 ng to 1,200 mg of drug in the caplet;
(3) a semipermeable wall that defines the caplet; and,
wherein the osmotic caplet is characterized by:
