Appeal No. 2003-0192 Application No. 08/871,300 Independent claims 20 and 21 are representative of the subject matter on appeal and a copy of those claims is appended to appellant's brief. The only prior art reference of record relied upon by the examiner in rejecting the appealed claims is: Goetz '379 4,919,379 Apr. 24, 1990 In addition to the foregoing prior art reference, the examiner has also relied upon applicant's admitted prior art (hereinafter the APA) shown in Figure 1 of the application and described on pages 1, 3 and 4 of the specification. Claims 20 through 22 stand rejected under 35 U.S.C. § 103(a) as being unpatentable over the APA in view of Goetz '379. Rather than reiterate the examiner's full commentary regarding the above-noted rejection and the conflicting viewpoints advanced by the examiner and appellant regarding the rejection, we make reference to the examiner's answer (Paper No. 25, mailed July 22, 2002) for the reasoning in support of the rejection, and to appellant's brief (Paper No. 24, filed May 30, 33Page: Previous 1 2 3 4 5 6 7 8 NextLast modified: November 3, 2007
