Interference No. 103,675 COUNT 3A Chen et al.: Claims 10 and 11 Bouchard et al.:Claim 141 COUNT 4 Chen et al.: Claims 1 through 6, 8 and 9 Bouchard et al.: Claim 140 The parties were provided an opportunity to file separate briefs in this proceeding, one addressing the issues raised by the various motions, including the motions specifically deferred to final hearing by the APJ, and one brief addressing the parties' respective cases for priority. Both parties have filed separate briefs addressing the issues raised in the motions. Chen et al., the junior party and, thus, the party bearing the burden of proof on the issue of priority filed a priority brief and Bouchard et al. filed a brief in opposition to Chen et al.'s priority brief. Bouchard et al.'s priority brief is little more than a statement by them that they rely on the filing date of their earlier filed French application for which they have been accorded benefit. Chen et al.'s motions brief is directed to their motions for benefit under 37 C.F.R. § 1.633(f) which were deferred to final hearing by the APJ in her decision of August 22, 1996 (Paper Number 53).
