Appeal No. 2004-1747 Application No. 09/932,723 layers for inflatable bladders, we agree with the examiner that it would have been obvious for one of ordinary skill in the art to select an impermeable material for the outer protective layer of an inflatable bladder in order to provide additional protection to both the contents within the bladder and the outside environment. Manifestly, since appellant admits that Baxter evidences that it was known in the art to use impermeable outer layers for inflatable bags used as containers for liquids, it would have been obvious for one of ordinary skill in the art to employ an outer impermeable layer to afford additional protection to the environment when the package transport contains fluid dangerous material. Appellant has advised us of no unexpected results attached to the use of the claimed inflatable bladder. Indeed, appellant bases no argument upon objective evidence of nonobviousness, including unexpected results. In conclusion, based on the foregoing, the examiner's decision rejecting the appealed claims is affirmed. -5-Page: Previous 1 2 3 4 5 6 7 NextLast modified: November 3, 2007
