Appeal No. 2005-0868 Application 09/969,728 The examiner argues that “[c]learly the combination of Muakami [sic] et al and Makaran teach the use of a starter (DC) motor protection circuit which utilizes a supply voltage detection to determine an over-temperature condition and either turn-off the power supply to the motor or control the conduction time” (answer, page 7). The examiner, however, does not point out support for that argument in Murakami and Makaran. For the above reasons we conclude that the examiner has not carried the burden of establishing a prima facie case of obviousness of the appellants’ claimed invention. 6Page: Previous 1 2 3 4 5 6 7 8 NextLast modified: November 3, 2007
