Appeal No. 2005-1132 Application No. 09/738,294 in Tang obtain presence and availability information over at least an STN. Appellants did not file a reply brief to contest these findings of the examiner. Therefore, we find that the examiner has made persuasive findings in support of unpatentability which findings have not been rebutted by appellants. Even though we have determined that the teachings of Klein are not necessary to support the rejection, the rejection based on the collective teachings of Tang and Klein is still appropriate. We also agree with the examiner that Tang teaches a visual indication of the availability of a team member for telephone communications [column 6, lines 47-50]. The indication of telephone use as suggested by Tang suggests obtaining that information using at least an STN as claimed. We now consider the rejection of claim 23 based on Tang, Klein and Lane.
