Appeal No. 2005-1932 Page 2 Application No. 10/191,311 BACKGROUND The appellants' invention relates to a device for cutting soft flexible sheet-like workpieces (specification, p. 1). A copy of the dependent claims under appeal is set forth in the appendix to the appellants' brief. Claim 9, the only independent claim on appeal, reads as follows: A device for cutting a soft, flexible, sheet-shaped workpiece along a predetermined cutting path, which comprises (a) a workpiece support, (b) a cutter head which can be positioned against the workpiece support and comprises (1) at least one cutter, and (c) a device for holding down the workpiece immobile on the workpiece support and operating in conjunction with the cutter head, the holding-down device being located laterally adjacent the at least one cutter and being adjustable in relation to the at least one cutter perpendicularly to the workpiece support, and the holding- down device consisting of (1) at least one pressure roller having a conical roller surface for engaging the workpiece and a trunnion extending transversely to the predetermined cutting path and inclined at an angle of less than 90° to the workpiece support. Claims 9 to 14 stand rejected under 35 U.S.C. § 103 as being unpatentable over the Appellants' Admitted Prior Art (AAPA) in view of U.S. Patent No. 2,889,623 to Baker.
