appellant’s independent claim 1. The examiner’s reference (answer,
page 3) to the ceiling (46) of the corridors (14, 14’) in Martin
to address appellant’s claimed ceiling extending from said first
rink side wall and said second rink side wall across the inter-rink
distance, is wholly unavailing. The corridor ceilings (46) have no
association with the rink side walls, do not span the inter-rink
distance, have nothing to do with the spectator viewing space of
Martin and, contrary to the examiner bare assertion on page 4 of
the answer, clearly do not meet the terms of the claims on appeal.
