Appeal No. 2006-0699 Application No. 90/005,937 1 THE REJECTION 2 Claims 27-29 stand rejected under 35 U.S.C. § 103(a) as being 3 unpatentable over Gagne in view of Intrad and Connew. 4 THE INVENTION 5 The invention relates to an emergency lighting system for 6 aircraft utilizing a photoluminescent strip mounted in a channel 7 secured to the floor of the aircraft. A transparent cover member 8 holds the photoluminescent member in place. (Abstract). 9 DISPOSITION 10 On consideration of the record, including the above-listed 11 materials, we reverse the Examiner's prior art rejection. 12 The Rejection of Claims 27-29 Under 35 U.S.C. § 103(a) 13 The Examiner has found that Gagne describes in its Figures 14 1-3 an emergency exit guidance system that includes a light- 15 transmissive plastic material (70) extending continuously over an 16 illumination strip (90). The Examiner has additionally found that 17 the light-transmissive plastic material includes opposed side 18 portions (71, 72) that locate and retain the illumination strip by 19 locking the plastic material (70) to the support (50). The top 20 wall portion of plastic helps to prevent the illumination strip 21 from being removed. The Examiner has further found that the 22 illumination strip (90) and plastic material (70) are considered 23 integral as they are attached together by the support.
