              Appeal No. 2006-1931
              Application No. 10/305,201
disputed that the reaction product of the example cited by the Examiner does meet the
requirements of components A and B of the claimed invention. Moreover, EP '467 discloses the
formation of aqueous adhesives. Second, the claimed invention is open to the inclusion of other
components in the adhesive composition. There is no requirement that the formed reaction
product be the sole source of the composition=s adhesive properties.
Regarding claims 19, 20, 33, 34, and 43, the Examiner acknowledges that EP '467 does
not recite products within the realm of these claims. (Answer, page 12). As such, to the extent
that the claims have been rejected over EP '467 alone this rejection is reversed.
Appellants' arguments regarding claims 28 and 29 (Brief, pp. 6 and 7) are not persuasive
because the claims are not limited to the scope of Appellants' arguments. In particular, the
claims are not limited to the reaction of unsaturated groups in a fatty acid with a maleic
anhydride. The subject matter of these claims read on the teachings of EP '467 identified by the
Examiner in the Answer. (See Answer, page 4).

5 We select claim 16 as representative of the rejected claims 16 to 18 and 21 to 32.
                                                             -5-
