1 Pursuant to the settlement agreement, Kanno is to file an express
2 abandonment of the involved Kanno application.
3 Kanno was authorized to file the express abandonment in the interference.
4 An express abandonment has been filed. Paper 28.
5 Upon consideration of the discussion during the conference call and the
6 filing of the express abandonment of the involved Kanno application, it is
7 ORDERDED that judgment on priority as to Count 1 (the sole count
8 in the interference; Paper 1, page 6) is awarded against Senior Party SHUICHI
9 KANNO, TOSHIAKI ARATO, SHINZO IKEDA, KEN YASUDA, HISAO
10 YAMASHITA, SHIGERU AZUHATA, SHIN TAMATA and KAZUYOSHI
11 IRIE.
12 FURTHER ORDERED that Senior Party SHUICHI KANNO,
13 TOSHIAKI ARATO, SHINZO IKEDA, KEN YASUDA, HISAO YAMASHITA,
14 SHIGERU AZUHATA, SHIN TAMATA and KAZUYOSHI IRIE is not entitled
15 to a patent containing claims 1-15 (corresponding to Count 1 of):
16 Application 11/294,376
17 filed 06 December 2005.

19 FURTHER ORDERED that if there is any additional settlement
20 agreement, attention is directed to 35 U.S.C. § 135(c).
21 FURTHER ORDERED that a copy of this JUDGMENT shall be
22 placed in the files of (1) Rossin Patent 6,673,326 B1 and (2) Kanno application
23 11/294,376.
24 FURTHER ORDERED that the Clerk is directed to distribute the files
25 upon entry of this JUDGMENT.
