                Appeal 2007-1461
                Application 10/463,956
                   2. Claim 17 requires a step of determining a delta value for at least one
                      flue gas component.
                   3. The Specification explains that:
To dampen measurement noise and reduce unnecessary control
fluctuations, the real-time measurements of the at least one flue
gas component are processed into a localized rolling average
signal. An overall average concentration of the at least one flue
gas component is determined from the plurality of real-time
measured concentrations. Thereafter, a delta value for the at
least one flue gas component at each of the locations is
determined. Delta values are the result of the difference
between the at least one flue gas component concentration at
each location and the overall average concentration of the at
                      least one flue gas component.
(Specification 6:8-16). This discussion does not specifically
define “delta value” in a way that disavows the plain meaning
                      arising from the terms.
                   4. Claim 17 also requires a combustion chamber having a “plurality of
primary combustion regions,” and a step of measuring a flue gas
component “at a plurality of locations …, each of said locations
corresponding to one of said primary combustion regions.”
                   5. Appellants do not define or limit the meaning of “primary combustion
region” but explain that “the method and system of this invention are
applicable to any furnace system employing multiple primary fuel
                      inputs.” (Specification 8:16-18.)
                   6. Kychakoff detects carryover particles for control of combustion
within the primary combustion regions of a furnace.
                   7. In Kychakoff, there are multiple fuel primary fuel inputs (nozzles 32
and 34 shown in Fig. 1) defining multiple primary combustion

                                                     4
