Appeal 2007-1787 Application 10/742,187 STATEMENT OF THE CASE Appellants seek our review under 35 U.S.C. § 134 of the Examiner’s final rejection of claims 13-15, all the claims currently pending in the application. We have jurisdiction under 35 U.S.C. § 6(b) (2002). SUMMARY OF DECISION We AFFIRM. THE INVENTION Appellants claimed invention is to a GPS-based system for controlling logistics in connection with a vehicle (Specification 1:5). Claim 13, reproduced below, is representative of the subject matter on appeal. 13. A logistics system to control application of ballast along a selected section of railroad and comprising: a railroad car including a ballast hopper and at least one hopper door engaged with said hopper and operable to open and close to respectively allow and prevent discharge of ballast from said hopper; a door actuator engaged with said hopper door and controllable to open and close said hopper door; a global positioning system (GPS) receiver engaged with said car and operative to generate a location signal representing a location of said car, said GPS receiver being adapted to receive GPS coordinate signals from a GPS satellite constellation; a position control subsystem coupled to said GPS receiver and said door actuator, said position control subsystem storing data from said GPS receiver representing a location of said selected section of said railroad along which application of ballast is desired; and said GPS receiver communicating information relating to the railroad car position to the position control subsystem whereby GPS position 2Page: Previous 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 Next
