Appeal 2007-3258 Application 10/916,195 1 Katsuki Fig. 2 shows an inner liner 3 formed on the inner periphery of 2 carcass layer 2 inside of the tire. Side wall 4 is disposed on the outer 3 periphery of carcass layer 2. Col. 6:9-13. 4 Fig. 3 is an enlarged sectional view of portion X of Fig. 2. 5 Inner liner 3 comprises a laminated film made up of gas barrier layer 6 A and adhesive layers B. The adhesive layer B is made of a modified 7 polyolefin resin or the like and is laminated on at least one surface of gas 8 barrier layer A. Col. 6:16-20. 9 Gas barrier layer A can be formed from a polyester resin. Col. 6:22. 10 Among the polyester resins which are said to be useful are 11 polybutylene terephthalate-polytetramethylene oxide glycol block 12 copolymers. Col. 3:22-24. 13 The Examiner found that Katsuki differs from the claimed invention 14 in that Katsuki "does not expressly teach the specific polyester copolymer of 15 the claimed invention." Examiner's Answer, page 4. 16 Cahill 17 Cahill's invention is directed to oxygen barrier materials of the active 18 oxygen scavenger type. Col. 1:9-11. 19 The principal emphasis of Cahill is to find an oxygen barrier layer 20 which can be used in bottles and packaging. Col. 1:11-12. 21 With reference to Cahill Fig. 1, there is shown a cross sectional view 22 of an oxygen scavenging bottle wall and film construction.
