Oregon Statutes - Chapter 568 - Soil and Water Conservation; Water Quality Management - Section 568.340 - Determination of no need for district; subsequent petitions may be filed.

(1) If the State Department of Agriculture determines after the hearing and after due consideration of the relevant facts, that there is no need for a soil and water conservation district to function in the territory considered at the hearing, it shall make and record such determination and shall deny the petition.

(2) After one year has expired from the date of the denial of the petition, subsequent petitions covering the same or substantially the same territory may be filed as provided in ORS 568.300 and new hearings be held and determinations made thereon. [Amended by 1981 c.92 §10]
