(1) Notwithstanding any other provision of law, in the absence of a contract providing otherwise, any person who purchases produce from a wholesale produce dealer shall make full payment therefor not later than the 30th day after the day the person took delivery of the produce.
(2) In addition to any other remedies provided by law, a wholesale produce dealer injured by a violation of subsection (1) of this section may bring an action for damages sustained as a result of the violation. In any such action, the prevailing party shall be allowed, in addition to costs and disbursements, reasonable attorney fees at trial and on appeal. [1985 c.426 §4]
