§ 3.1-188.40. (Repealed effective October 1, 2008) Seizure and disposition of seized nursery stock

In order to prevent the introduction or dissemination of any dangerous plant pests, any nursery stock, article, or material shall be subject to seizure on complaint of the Commissioner to a court of competent jurisdiction in the county or city in which the nursery stock, article, or material is located. In the event the court finds the nursery stock, article, or material to be in violation of the provisions of this article and orders the condemnation thereof, such nursery stock, article or material shall, at the owner's expense, be seized, destroyed, treated, or returned to the point of origin.
