§ 3.1-348. (Repealed effective October 1, 2008) Defenses to prosecution

No person shall be convicted under the provisions of this article:

(a) When such person is not a party to the packing, grading or marking of such product;

(b) When the agricultural product involved has passed inspection by an authorized inspector in the voluntary inspection service of the Virginia Department of Agriculture and Consumer Services, or the United States Department of Agriculture, and found to be marked in accordance with the requirements of this article.
