§ 3.1-763.3. (Repealed effective October 1, 2008) Indemnity to owner

At such time as the Commonwealth is approved for and becomes eligible to participate in and receive funds from the United States Department of Agriculture pursuant to United States Public Law 87-209; 75 Stat. 481 (21 U.S.C.A. 111-113 et seq.), the Commissioner may obtain an appraisal of the fair market value of any swine destroyed pursuant to this article and indemnify the owner thereof for the value of such swine destroyed in an amount equal to the indemnity paid by the United States Department of Agriculture, but in no event shall such indemnity exceed fifty dollars per head for registered stock and forty dollars per head for grade stock, and in no event shall the total indemnity paid by the Commissioner and the United States Department of Agriculture exceed the appraised value of such swine. In cases where salvage is received by the owner of the swine, the amount of salvage shall be deducted from the appraised value of the swine in computing the amount of State indemnity.
